Resumo: A presente digressão teórica tem por fim estudar o conceito e o mapa evolutivo dos Direitos Fundamentais, desde a sua origem como direitos naturais do homem até a sua positivação nas Constituições e sua abrangência internacional. Para tanto, analisaremos os documentos e suportes fáticos e culturais que formaram o marco das três gerações de Direitos Fundamentais, transformando-os em garantias do homem em face do Estado soberano. A partir desse estudo, poderemos constatar a real finalidade desses direitos, sua extensão e conseqüências históricas, auxiliando-nos na compreensão do contexto atual e na busca de soluções para a crise do Estado Contemporâneo.

Abstract: The present theoretical digression has the purpose to study the concept and the evolution map of the Basic Rights, since its origin as natural laws of the man until it has been written in the Constitutions and its international extension. To do this, we will analyze the documents and the factual and cultural supports that had formed the landmark of the three generations of Basic Rights, transforming them into guarantees of the man against to the sovereign State. Through this study, we will be able to identify the real meaning of these rights, its historical extension and consequences, helping the understanding of the current context and the solutions to the crisis of the Contemporary State.
