Resumo: O presente trabalho objetiva o estudo da compatibilidade das políticas de ação afirmativa e de cotas para negros implantadas pelo Estado brasileiro com o ordenamento jurídico internacional e nacional. As medidas adotadas serão analisadas à luz da legislação nacional, dos instrumentos internacionais de proteção dos direitos humanos com recorte racial ratificados pelo Estado brasileiro, da doutrina e dos julgamentos de alguns casos apreciados pelo Poder Judiciário. Por fim, conclui-se pela compatibilidade das referidas políticas com o sistema legal brasileiro e a necessidade de que sejam ampliadas e aperfeiçoadas.

Abstract: The present work aims at examining the compatibility of affirmative action policies and quotas for afrodescendants (Blacks) implemented by the Brazilian State with both the national and international legal order. The actions taken will be analized in light of the national law, as well as of the international human rights protection instruments with a racial/ethnic approach that have been ratified by Brazil, and of the doctrine and some cases judged by the Brazilian Judiciary. In the end, the author comes to the conclusion that the above-mentioned actions with the Brazilian legal system as well as the need for these actions to be broadened and improved.
