Abstract: This article is about the matter of the use of hallucinogenic substances with religious means in the United States of America. The Supreme Court of Justice of the USA granted to "Centro Espírita Beneficente União do Vegetal" (UDV) the right to use the Huasca given the religious sincerity of the practitioners.

The author analyzes the case from the material and procedural point of view, speaking, also, of petitions of the North American government and the UDV.
